The following document describes the conditions under which Luxy Fun offers you access to its website and related services. Please read these Terms and Conditions of Use carefully to ensure that you understand them. By using this site, you agree to comply with and be legally bound by the following terms of use (hereinafter, the “Terms”). If you do not agree to these Terms, you are not entitled to obtain information or continue using this site.

Luxy Fun (hereinafter, the “Company”) reserves the right to deny the user full or partial access to the site, unilaterally and without prior notice, especially in the event of a clear violation of these Terms.

1. ELIGIBILITY AND RIGHT OF ADMISSION

1.1. Minimum age: You must be at least 18 years old to register on the site. This applies to both “Luxy King Gentlemen” and “Luxy Queen Women.” By reaching the age of majority, you represent and warrant that you have the right, authority, and capacity to give consent and enter into this Agreement.

1.2. Purpose of the site: This Site is intended for entertainment, social networking, and lifestyle purposes. It is not intended to support immoral or illegal interests.

1.3. Nature of the service: Luxy Fun is an intermediary platform that facilitates contact between “Luxy King Gentlemen” and “Luxy Queen Ladies” and ensures the proper performance of activities and events organized by the Company or by third parties, provided that this quality is duly notified. Luxy Fun is not an escort agency, nor does it provide services of a sexual nature. The Company only offers a meeting service after prior digital selection, in a secure space. However, what happens outside the premises is not the responsibility of either the Company or the site in question.

1.4. Admission reservation: The Company reserves the unilateral, discretionary, and definitive right to admit, reject, or remove any user (whether Gentleman or Hostess) at any time, without prior justification, if it is considered that the profile does not align with the brand’s standards of excellence, lifestyle, or values.

2. DESCRIPTION OF PROFILES

2.1. Luxy King Gentlemen or Gentlemen: High-income traveling users seeking social companionship, local guides, or assistance at events in the cities where we operate. Gentlemen pay for access to the platform, connection management, and all expenses related to the in-person meeting, which may include bills, service fees, and others.

2.2. Luxy Queen Women or Hostesses: Users who offer their time, knowledge of the city, and social companionship for events, dinners, or tourism. They participate voluntarily and may receive incentives for their time through the Luxy Stars (LS) system.

2.3. Verification: The Company reserves the right, but is not obligated, to verify the identity of users (KYC). Hostesses must complete different levels of verification according to their category in order to validate their identity, age, and knowledge. All processes involving money, whether for the payment of a membership or the redemption of “Luxy Stars” (LS), will be duly verified. Initial registration on the site constitutes only an “application for membership” and does not grant membership status until the Company issues express approval.

3. ECONOMIC MODEL AND LUXY STARS (LS)

3.1. Pay-per-connection: Gentlemen purchase memberships or credits to unlock profiles and arrange dates with Hostesses through the platform and its communication channels. This payment is for the use of Luxy Fun’s technology, not for the person. Therefore, the Hostess owes nothing to the Gentleman with whom she has the date.

3.2. LS Incentives: Hostesses accumulate “Luxy Stars” (LS) for accepted and successfully completed invitations. These LS are points that can be exchanged for benefits or financial compensation according to the Company’s current table.

3.3. External expenses: The Gentleman acknowledges that expenses arising from the meeting (restaurants, transportation, event tickets, etc.) are unrelated to the platform and must be covered by him, unless otherwise agreed privately between the parties.

4. USER CONDUCT AND PROHIBITED ACTS

You agree to act with judgment and respect. The following is strictly prohibited:

4.1. Using the site to solicit or propose paid sexual acts or erotic services.

4.2. Harassing, threatening, or discriminating against other members.

4.3. Posting defamatory, obscene, violent content or content that infringes on the intellectual property rights of third parties.

4.4. Impersonating any person or entity.

4.5. Using the information obtained on the site for commercial purposes unrelated to Luxy Fun or to send spam.

5. MEMBER RESPONSIBILITY

5.1. Meeting place: Luxy Fun is responsible for arranging the face-to-face meeting between the Gentleman and the Hostess at a location (restaurant, bar, event, etc.) selected strictly for that purpose, guaranteeing both parties a luxurious, safe, and confidential encounter. To this end, the Company will reach agreements and implement protocols with the administrators of these venues. However, the Company has no control over the conduct of users outside the website.

5.2. Personal safety: You are solely responsible for determining the identity and suitability of the people with whom you choose to interact. Luxy Fun acts as a filter and selects the meeting place, but we recommend taking the same precautions you would take when meeting any stranger in person.

5.3. Indemnification: In the event of a dispute between users, you release Luxy Fun and its officers from any claims, demands, or damages of any kind arising from such dispute.

6. TERMINATION AND CANCELLATION

6.1. By the Company: We reserve the right to cancel your access without prior notice if we determine a violation of these Terms or for any activity suspected of being illegal.

6.2. Subscriptions and refunds: The Knight may cancel his membership at any time. Given immediate access to the profile database, payments made are non-refundable, unless otherwise required by local consumer protection law.

6.3. Loss of LS: If an account is closed due to inappropriate behavior or violation of terms, all accumulated Luxy Stars (LS) will be forfeited without compensation.

7. LIMITATION OF LIABILITY

7.1. Luxy Fun shall not be liable for any direct, indirect, or incidental damages (including physical injury, emotional distress, or death) resulting from communications or meetings with other registered users.

7.2. The site is provided “as is,” with no guarantees that the service will be uninterrupted or error-free.

8. INTELLECTUAL PROPERTY AND PRIVACY

8.1. By submitting any content (including, without limitation, your photograph) to the site, you grant the Company a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, perform, adapt, modify, distribute, have distributed, and promote such content in any form, in all media now known or hereafter created, and for any purpose.

8.2. Privacy: You agree that your photos and profile may be viewed by other users, unless you expressly indicate otherwise. Luxy Fun does not sell your data to third parties, but reserves the right to transfer it to comply with court orders or protect the security of the site.

8.3. You are solely responsible for any content you submit, post, or transmit through the site. You may not post or submit any content that:

8.3.1 is defamatory;

8.3.2 disparages any ethnic, racial, sexual, or religious group through stereotypical or other representations;

8.3.3 exploits images or likenesses of persons under the age of 18;

8.3.4 depicts the use of illegal drugs;

8.3.5 uses offensive language or images;

8.3.6 portrays violence as acceptable, glamorous, or desirable;

8.3.7 provides a link to any commercial website;

8.3.8 contains any personal contact information, unless specifically required or requested as part of your registration on this site

8.4 You will select a username as part of the registration process. A password will be sent to the email address you provide during the registration process. You may change the password provided at any time. You are solely responsible for the confidentiality and use of your username and password. You must: (a) log out of your account at the end of each session on the site; (b) immediately notify the Company’s support service of any unauthorized use of your username and password or any other breach of security.

9. APPLICABLE LAW AND JURISDICTION

9.1. All disputes related to the use of the site shall be governed by the laws of the State of Florida, United States of America, and shall be subject to the exclusive jurisdiction of its courts.

9.2. Notwithstanding the foregoing, users agree to comply with local laws in force in the cities where the meetings take place (Quito, Bogotá, Lima, and Miami), especially with regard to data protection and public order.

Acceptance

Continued use of Luxy Fun constitutes full acceptance of these Terms. If you are using the platform on behalf of an entity, you warrant that you have the authority to bind that entity to these Terms.
