2.- CONSENT OF THE DATA SUBJECT
By registering with Luxy Fun, the user (hereinafter “Luxy King” for men or “Luxy Queen” for women) grants their prior, express, and informed consent for Luxy Fun to collect, store, use, and process their personal data for the purposes described in this document. The processing is based on the necessity for the performance of a contract (the Terms and Conditions) and the legitimate interest in security.
3.- PERSONAL DATA COLLECTED
Luxy Fun collects data from two categories of users:
General Information (for all users):
First and last names.
Email address.
Mobile phone number (WhatsApp and/or Telegram).
Profile photos and multimedia content (required for Luxy Queens and optional for Luxy Kings).
Geolocation data (required only for in-person meetings or dates).
Browsing data (cookies, IP address, device type).
Verification data (specific to Hostesses):
Copy of official ID (ID card, national ID, or passport).
Verification photo (selfie with ID or specific gesture) for the KYC (Know Your Customer) process.
Bank or e-wallet details (only for redeeming Luxy Stars – LS).
4.- PURPOSES OF DATA PROCESSING
The data collected by Luxy Fun is used for the following specific purposes:
Connection management: To allow Luxy Kings to view profiles and Luxy Queens to receive invitations.
Security and verification: To verify that users are of legal age (18+) and to verify the authenticity of profiles in order to prevent fraud and identity theft.
Luxy Stars (LS) System: To manage the accumulation, reporting, and redemption of rewards for Luxy Queens.
Technological intermediation: Luxy Fun acts as an intermediary for meetings, and the parties will not have access to each other’s contact information until they meet in person and decide to share it at their own discretion and with mutual consent. Luxy Fun does not disclose contact information prior to the meeting.
Communications: Send notifications regarding invitation requests and acceptances, service updates, and security alerts.
Legal Compliance: Respond to requests from competent authorities in the jurisdictions where we operate.
5.- PROCESSING OF SENSITIVE DATA
Luxy Fun does not request sensitive data related to racial origin, religious beliefs, political views, or health information. The images provided are used exclusively for the visual and aesthetic identification of the profile within the platform’s ecosystem. The user has the right to withhold sensitive data not required by the nature of the service.
6.- INTERNATIONAL TRANSFER AND TRANSMISSION
Luxy Fun is an entity headquartered in the United States. The user agrees that their data may be stored on servers located in the U.S. or other jurisdictions with adequate protection standards. Personal data may be shared with service providers (payment gateways, cloud hosting services, and identity verification tools) under strict confidentiality agreements.
7.- DATA SUBJECT RIGHTS (ARCO RIGHTS)
In accordance with the laws of Ecuador, Colombia, and Peru, users may exercise the following rights:
Access: To know what personal data we hold.
Rectification: To update or correct inaccurate or incomplete data.
Deletion: Request the deletion of your data when it is no longer necessary or consent has been revoked.

Restricted access for administrative staff under confidentiality agreements.
Security breach notification protocol within a maximum of 72 hours (in accordance with FIPA and LOPDP).
9.- EXTERNAL COMMUNICATIONS (WHATSAPP AND/OR TELEGRAM)
Luxy Fun acts exclusively as a facilitator and curator of the initial contact until the physical meeting takes place. Once the connection is formalized and users decide, by mutual agreement, to exchange external contact details (such as phone numbers or messaging profiles), the relationship enters a strictly private sphere. Luxy Fun does not monitor, store, or assume any responsibility for the communications, agreements, or conduct that the parties maintain after the date or outside the digital environment of our platform.
10.- MINORS
The service is strictly prohibited for minors under the age of 18. Luxy Fun uses verification filters and, if it detects an account belonging to a minor, it will immediately delete the data and permanently block access.
11.- MODIFICATIONS
Luxy Fun reserves the right to modify this policy at any time. Significant changes will be notified via the website or by email. Continued use of the service implies acceptance of the updated policy.
12.- ACCEPTANCE
By checking the “I accept the Privacy Policy” box during registration, you confirm that you have read, understood, and accepted the processing of your personal data by Luxy Fun under the terms set forth herein.
